Understanding Philippine labour law for foreign employers

17 June 2026 ยท 7 min read

In short

Philippine labour law strongly protects employees, with clear rules on regularisation, working hours, mandatory benefits, and termination. Foreign employers must follow due process on exits, respect security of tenure, and meet statutory obligations. Getting this wrong is costly, which is why most foreign employers use compliant local infrastructure.

Philippine labour law is employee-protective and process-heavy. For foreign employers, the safest path is understanding the basics and employing through compliant infrastructure. Here is the overview every employer should know.

Security of tenure

Philippine law protects security of tenure under the Labor Code of the Philippines. After a probationary period, employees generally become regular employees with strong protection against dismissal. You cannot let someone go at will; there must be a valid ground and due process.

Working hours and overtime

The standard is eight hours a day, with defined rules on overtime, night differential, rest days, and holiday pay. These are set out in the Labor Code, are statutory, and apply regardless of where the employer is based.

Mandatory benefits

Beyond salary, employers must provide statutory contributions (SSS, PhilHealth, Pag-IBIG), 13th-month pay, and statutory leave entitlements. These are not negotiable and must be handled correctly.

Termination and due process

Ending employment in the Philippines requires a valid ground and strict due process, including notice and an opportunity to respond. Getting termination wrong exposes an employer to claims. This is one of the strongest reasons foreign employers use an employer of record, which carries the compliance responsibility.

Why compliance matters

Non-compliance is not a minor admin issue; it creates real legal and financial exposure. Employing through compliant local infrastructure means these obligations are handled correctly, so you can focus on the work, not the paperwork.
